New York Fishing License and Border-Water Checklist
Review New York fishing licence requirements, exemptions, residency and the rule that a New York licence does not cover Ontario water.

You fish the New York shore of the Niagara under statewide license rules and special water rules. You need a valid license in your possession while you fish or help someone to fish unless a narrow exception on the License Information and Fees page covers you.
Who needs a New York fishing license on your trip?
Help includes handling the rod, netting a fish, or handling bait for a child or friend. The License Information and Fees page was last updated on May 13, 2021, and requires you to carry your license with you. This applies when you fish from a New York bank, pier, or boat on the state side near upper river habitats and shore access.
Who is exempt from the license rule?
The page lists five groups exempted only under location-specific conditions. Persons under 16 years of age are exempt everywhere. Resident owners, lessees, and members of their immediate families who occupy and cultivate farmlands are excused when fishing on their own lands. Persons who hold farm fish pond licenses and members of their immediate families are excused when fishing on waters covered by their licenses. Licensed fishing preserves create another place-based exception for fishing on those preserves. Resident patients at Department of Mental Health institutions and Department of Health rehabilitation hospitals, and inmates at Division of Youth rehabilitation centers, are excused upon request through the hospital or institution by writing to the NYSDEC License Sales Unit at 625 Broadway, Albany, NY 12233-4790. If you are 16 or older and do not meet the land, pond, preserve, or care setting conditions, you need your license with you.
How do free licenses work if you qualify?
A free license is still a license you obtain, and eligible people may obtain it at any license-issuing outlet unless a different channel is specified. New York State residents who are legally blind and provide a doctor's note to the license-issuing agent qualify. New York State residents who are active service members of the NYS Organized Militia, described as the National Guard, or United States Reserve Forces also qualify. Residents stationed outside New York on full-time active duty in the United States Armed Forces on leave in New York for no longer than 30 days qualify. Resident patients at United States Department of Veterans Affairs hospitals or state-funded facilities obtain a free fishing license through their hospital or facility. Native Americans who are members of the Shinnecock and Poospatuck tribes or the Six Nations residing on reservations in New York State obtain a free fishing license by contacting their reservation or the DEC License Sales Office at 518-402-8843.
Do not confuse a free license with a license exemption. The people in the free-license categories still obtain a license through the outlet or institution named for them. By contrast, the exemptions above apply only to the person and place described, such as a qualifying family fishing its own cultivated farmland or a person fishing on a licensed preserve. If neither description matches your trip, carry the valid license required for you.
Do you qualify as a New York resident for the license?
To qualify for an annual resident license, a person must live in New York State for more than 30 days immediately preceding the date of application. For a lifetime license, show proof of residency for one full year. Residency is the place where a person maintains a fixed, permanent, and principal home, regardless of where the person is temporarily located, as shown by where the person is registered to vote. Land ownership in New York does not make you a resident. If you are under 18, the residence of your parents or legal guardian counts. If you are stationed in New York with the Armed Forces or studying full-time in residence during the school year, you qualify for annual resident licenses with proof. DEC lists valid documents to prove residency.

Use that structure to keep two checks separate: first, confirm that you hold the required license, then open the rule page for the water and species you intend to fish.
What should you carry and check before you fish the Niagara shore?
A New York fishing license does not entitle its holder to fish the Ontario portion of the Niagara River. The same table answers no for the Ontario portions of Lake Erie and Lake Ontario and for the Ontario or Quebec portions of the St. Lawrence River. A license also does not authorize trespass on private land or water, or interference with property belonging to another person. Those limits remain separate from the question of whether the license itself is valid.
